Article 1 - Responsible person

Article 2 - Applicability

1. These terms and conditions apply to all legal relationships between the Sadaqah Smile Foundation and donors, users, participants and visitors.
2. Deviations from these conditions are only valid if expressly agreed in writing.
3. The most current version of the terms and conditions, as published on the Sadaqah Smile website, is always decisive.

Article 3 - Purpose and nature of donations

1. Donations to Sadaqah Smile are voluntary.
2. Donations do not qualify as a purchase and do not entitle you to any enforceable consideration.
3. Donations are used in accordance with the statutory objectives of the foundation and the applicable donation policy, as published on the website.

Article 4 - Types of donations and initiatives

1. Sadaqah Smile can offer the following types of donations, among others:
   • One-time donations
   • Periodic (monthly) donations
   • Project-oriented donations
   • Zakat and sadaqah
   • Donations for specific initiatives or campaigns
2. The range of projects, initiatives or donation forms can be expanded or adjusted in the future.

Article 5 - Destination of donations and force majeure

1. Donations are used for projects and activities in the relevant country or target area.
2. If implementation of a project is not possible (on time) due to circumstances such as:
   • Safety situations
   • Force majeur
   • Legal or logistical restrictions
3. In such cases the board may decide to:
   • to use the donation elsewhere within the same country, or
   • to temporarily hold the donation until implementation is possible.
4. Donors cannot derive any individual right or claim from this.

Article 6 - No refunds

1. Donations are irrevocable and non-refundable.
2. Refunds are only possible in the event of a demonstrable error, such as a double debit.
3. Sadaqah Smile decides on refunds exclusively in accordance with reasonableness and fairness.

Article 7 - Periodic (monthly) donations

1. Periodic donations can be canceled by the donor at any time:
   • via the personal account, or
   • by email.
2. Cancellation can take place immediately.
3. The donor is responsible for correctly completing payment and personal information and keeping it up to date.
4. In the event of failed direct debits, payment may be resubmitted several times.
5. If payment is structurally missed, the periodic donation will be automatically terminated.
6. There are no fines, costs or sanctions associated with terminating a periodic donation.

Article 8 - Accounts

1. Donors can create a personal account.
2. Through the account, donors can:
   • view donations
   • manage recurring donations
   • adjust personal data
3. The user is responsible for carefully handling login details.
4. Sadaqah Smile reserves the right to block or terminate an account in the event of abuse, fraud or unlawful use.

Article 9 - Payments

1. Donations are processed through third-party payment providers, including Stripe.
2. Sadaqah Smile does not have access to full payment card details.
3. Payments are made in accordance with the terms and conditions of the relevant payment provider.

Article 10 - Communication

1. Sadaqah Smile can communicate via email for purposes including:
   • donation confirmations
   • updates and developments
   • service messages
   • fundraising communications
2. It is possible to unsubscribe from communications at any time.

Article 11 - Privacy

1. The processing of personal data takes place in accordance with the applicable privacy legislation (GDPR).
2. Sadaqah Smile's privacy statement applies to the processing of personal data, as published on the website.
3. The privacy statement is an integral part of these terms and conditions.

Article 12 - Changes

1. Sadaqah Smile reserves the right to change these terms and conditions.
2. The most recent version on the website always applies.
